１．Purpose of these Terms and Conditions
These Terms and Conditions set forth the conditions for the use of this service and the agreements concerning the rights and obligations between us and the customer when the customer uses our shop (hereinafter referred to as "this service").
This service: The sale of our products (hereinafter referred to as "the products") in our shop.
By using our shop and this service, the customer is deemed to have agreed to the terms and conditions.
２．Management of ID and password
(1) The customer shall be responsible for the strict management and safekeeping of the user ID and password set by the customer when using this service, and shall not transfer, sell, succeed, lend, disclose, or leak them to a third party.
(2) If the customer discovers that their user ID or password has been used fraudulently by a third party or there is a risk thereof, the customer shall immediately contact us.
(3) The customer shall be solely responsible for any damages caused by insufficient management of the user ID or password, errors or negligence in use, unauthorized use by a third party, etc., and we shall not be liable for any such damages.
(4) Any act performed using the customer's user ID and password shall be deemed to be an act of the customer, and the customer shall be responsible for the results of such act.
(5) The customer shall recognize the risks of leakage, etc., associated with the act of sending credit card numbers when using this service, and shall do so at their own risk.
３．Formation of sales contract
(1) The sales contract for the products between the customer and us shall be formed at the moment the customer clicks the order button on the "order screen."
(2) Applications for the purchase of products by minors shall be deemed to have been made under the responsibility of their guardians.
(3) We shall be able to charge the customer for the price based on the sales contract formed between the customer and us after the sales contract is concluded.
４．Our right to cancel sales contracts
(1) If the customer's purchase of the products falls under any of the following, we may cancel, terminate, or take other measures deemed appropriate by us.
① If the customer violates the prohibited acts specified in Article 8.
② In addition, if there is any fraudulent or inappropriate act or the risk thereof regarding the customer's use of this service.
③ If the product cannot be delivered due to an unknown address or long-term absence.
④ If the product is out of stock and cannot be easily delivered.
⑤ If the customer fails to pay the price within the specified period.
⑥ If the customer's designated credit card is suspended.
⑦ If circumstances are found that indicate the customer's payment ability has become precarious.
５．Return and exchange of products
(1) We do not accept cancellations after the formation of the sales contract. Please check the product and delivery date carefully before placing your order.
(2) While we take every precaution regarding the quality of the products, in the unlikely event that a wrong size or color, or a defective product is delivered, please contact us by phone or through the Contact Form within 7 days of the product's arrival. We will handle the return shipping costs.
(3) We do not accept returns or exchanges of products due to customer's convenience, or for reasons other than those specified in the preceding paragraph. Please note that even if the conditions in the preceding paragraph are met, we cannot accept returns or exchanges for the following products:
・Products that have been 8 days or more since their arrival
・Products that have been used once by the customer
・Products that have been damaged or soiled by the customer
・Products that have been processed or repaired by the customer
・If the product's box, tags, instruction manual, or other accessories are soiled, damaged, or lost.
６．Suspension or interruption of this service
(1) We may suspend or interrupt the provision of this service if any of the following applies:
① When regular or emergency maintenance of our shop or this service's system is performed.
② When a third party providing services on our behalf (such as payment processing, data analysis, email sending, hosting services, customer service) or a third party supporting our marketing performs regular or emergency maintenance of their system, or suspends or interrupts their service.
③ When the provision of this service becomes impossible as usual due to war, riots, civil unrest, infectious diseases, labor disputes, earthquakes, volcanic eruptions, floods, tsunamis, fires, other natural disasters, power outages, or other emergencies.
④ In other cases where we determine that a temporary interruption is necessary for the operation of this service.
⑤ When the provision of this service becomes technically difficult or impossible.
(2) When we suspend or interrupt the provision of this service based on the provisions of the preceding paragraph, we shall notify the customer in advance. However, this does not apply in urgent and unavoidable circumstances.
(3) We shall not be liable for any damages whatsoever (including all damages, losses, and disadvantages, including mental distress, hereinafter the same in these Terms and Conditions) incurred by the customer, directly or indirectly, due to our suspension or interruption of the provision of this service based on the provisions of this Article.
７．Disclaimer
(1) We shall not be liable for any damages whatsoever caused to the customer or a third party through the provision of this service and the customer's use of this service (including our information provision activities incidental thereto), unless there is intentional misconduct or gross negligence on our part. Even if we are liable, our liability shall be limited to direct and ordinary damages, and we shall not be liable for lost profits or other special damages incurred by the customer or a third party under any circumstances.
(2) If the customer causes any damage to another customer or a third party by using this service, the customer shall resolve it at their own responsibility and expense, and shall not cause any damage to us.
(3) If our shop provides links to other websites or resources, or if a third party's website or resource provides links to our shop, we shall not be liable for the content, use, or results (including, but not limited to, legality, validity, accuracy, reliability, safety, recency, and completeness) of such linked sites. Furthermore, if we reasonably determine that the content of a linked website or resource is illegal or inappropriate for the management and operation of our shop, we may delete such linked site without any notice to the customer.
(4) If there are transactions (including, but not limited to, participation in promotions such as sweepstakes) with advertisers (including, but not limited to, prize advertisements) in our shop, the customer shall conduct such transactions with the advertiser at their own discretion and responsibility, and we shall not be liable for anything related thereto. We do not guarantee any content or conditions related to transactions, such as payment of product prices, determination of contract terms, warranties, liability for defects, and availability of licenses, and we shall not be liable for any damages incurred by the customer due to transactions conducted via advertisements or promotions posted on our shop.
(5) Even if we have taken reasonable safety measures, if unauthorized access to data related to our shop, contamination with computer viruses, or other unauthorized acts occur, and the customer incurs damages as a result, we shall not be liable for any such damages.
８．Prohibited acts
(1) The customer shall not perform any of the following acts. In the event that we or a third party incur damages in violation of these provisions, the customer shall be responsible for compensating all such damages.
① Acts that cause or may cause annoyance, disadvantage, or damage to other customers, users of our shop, other third parties, or us.
② Acts that infringe or may infringe on the intellectual property rights, such as copyrights, portrait rights, personality rights, privacy rights, publicity rights, or other rights of other customers, users of our shop, other third parties, or us.
③ Using our shop or this service for commercial purposes. (This includes reselling products or using this service at the request of a third party; however, this excludes cases where we have given prior approval.)
④ Acts that violate public order and morals or other laws, or acts that may do so.
⑤ Registering information containing false or misleading content.
⑥ Using, reproducing, selling, publishing, distributing, disclosing, or performing similar acts with content obtained through our shop without our permission.
⑦ Collecting, storing, or saving personal information of other customers, users of this site, or other third parties through our shop.
⑧ Transferring, assigning, or allowing others to exercise the rights and obligations or position as a customer to other customers or third parties.
⑨ Illegally using user IDs and passwords. (This effectively includes allowing a third party to use this service, regardless of the purpose, through the customer's user ID and password.)
⑩ Uploading computer viruses, computer codes, files, programs, or other content designed to interfere with, destroy, or limit the functionality of computer software, hardware, or communication devices to our shop, or sending them by email or other means.
⑪ Other acts that we reasonably determine to be inappropriate, such as damaging or discrediting our reputation.
９．Changes to these Terms and Conditions
(1) We may, at our reasonable discretion, change all or part of these Terms and Conditions from time to time without prior consent from the customer, by posting them on our shop's website in advance, and the customer agrees to this.
(2) If all or part of these Terms and Conditions are changed, the changed terms and conditions shall apply to the use of our shop and this service, and the customer shall comply only with the changed terms and conditions.
10．Miscellaneous
These Terms and Conditions shall be governed by Japanese law, and the Tokyo District Court shall be the exclusive agreed court of first instance for any disputes arising out of the provision and use of this service.
